الملخص
يتطرق البحث إلى كشف معاني هذه القاعدة الفقهية؛ وهي كليّة من حيث كونُها اندرجت تحتها قواعد فقهية عديدة، يُضبط بها تصرّف الإمام ومن ينوب عنه مّمن وكُّل بالقضاء عند التنازع والتداعي بين المتجاورين في العمران السكني، بما يحفظ حقوقهم، ويخدم مصالحهم ويحقق أغراضهم وفق المصلحة التي قصدها الشارع الحكيم من الأمن والاطمئنان والاستقرار ودفع الأضرار. وقد تمّ السير في هذا البحث، باستخدام أداة الاستقراء الناقص، لتعذّر الاستقصاء، وتم ذلك بتتبع القواعد والأحكام المتعلقة بالبيوت والدور والبنيان والجدار من مضانها، والتي يجمعها موضوع واحد وهو المصالح وما يقابلها من الأضرار بتفويتها، مع انتخاب نماذج في ذلك بما يخدم البحث، كما اعتمد على المقاربة في ضبط الأحكام؛ فلا دعوى تحقيق أو تقرير. وتم التوصّل في نهاية البحث إلى أنّ العمران السّكني تحكمه قواعد شرعية وضوابط فقهية يُفصل بها في الحقوق الجوارية، التي هي أساس سياسة الإمام حفظا لقداسة الجار، ويُدفع بها الأضرار التي قد تحصل بسبّب طبيعي أو بتصرّفات المتجاورين، وذلك بردّ القائم على ميزان الاعتدال، الكفّة عند إرادة ترجيحها، حسما لمادة النزاع، وتحقيقا للاطمئنان والاستقرار في معاملات التعايش بين النّاس. The research deals with revealing the meanings of this jurisprudential rule; It is a totality in that it has many jurisprudential rules under which the behavior of the imam and his representative is controlled by those who have been appointed in the judiciary in the event of conflict and conflict between neighbors in the housing urban management, in a manner that preserves their rights, serves their interests and achieves their purposes in accordance with the interest intended by the wise leg of security, confidence, stability and payment of damages . This research was conducted using the incomplete induction tool, due to the impossibility of investigation, and this was done by following the rules and provisions related to homes, houses, buildings and walls from their fluorescence, which are united by one topic, which is the interests and the corresponding damages by missing them, with the selection of models in this to serve the research, as Rely on the approach to controlling provisions; There is no investigation or report. At the end of the research, it was concluded that the residential development is governed by legal rules and jurisprudential rules by which the neighborhood rights are decided upon, and the damages caused by the actions of the neighbors are repelled by it. coexistence transactions.
