ادعاء جنوب افريقيا، بارتكاب اسرائيل إبادة جماعية بقطاع غزة ( قراءة في منطوق قرار محكمة العدل الدولية )

الملخص : أمام هول المأساة الانسانية الناجمة عن الحرب الوحشية والهمجية التي شرعت إسرائيل في خوضها ضد الشعب الفلسطيني بقطاع غزة بداية من الـ 27 تشرين الاول / أكتوبر 2023 ، بذريعة استخدام حقها في الدفاع عن النفس، ردا على عملية طوفان الاقصى، التي قامت بها كتائب الشهيد عز الدين القسام وفصائل فلسطينية مسلحة أخرى بتاريخ 7 تشرين الاول / أكتوبر 2023 . وفي موقف فاجأ الجميع، أعلنت محكمة العدل الدولية، أن دولة جنوب افريقيا قد رفعت إليها بتاريخ 29 كانون الاول / ديسمبر 2023 ، دعوى تتهم فيها اسرائيل بارتكاب أعمال إبادة جماعية ، معللة طلبها بأن اسرائيل قد انتهكت التزاماتها المنصوص عليها في اتفاقية منع الابادة الجماعية والمعاقبة عليها لعام 1948، التي تكفل للشعب الفلسطيني بقطاع غزة الحماية من الابادة الجماعية . وقد استمعت المحكمة في جلستين علنيتين انعقدتا بمقر المحكمة بلاهاي يومي 11 و12 كانون الثاني/ يناير 2024 ، لادعاءات جنوب افريقيا ومرافعات اسرائيل ، وأصدرت قرارها بشأن الشق الاستعجالي للدعوى بتاريخ 26 كانون الثاني / يناير 2024 . وقد وجهت ستة أوامر لإسرائيل ، من بينها الامر بأن تتخذ اسرائيل تدابير في حدود امكانياتها لمنع ارتكاب أفعال الابادة الجماعية المنصوص عليها في المادة الثانية من اتفاقية منع الابادة الجماعية والمعاقبة عليها، وامرت المحكمة اسرائيل أيضا، بأن ترفع تقريرا للمحكمة في غضون شهر، عن التدابير التي اتخذتها لتنفيذ هذه الاوامر. Abstract: Faced with the horror of the human tragedy resulting from the brutal and barbaric war that Israel began waging against the Palestinian people in the Gaza Strip from October 27, 2023, under the pretext of using its right of self-defense, in response to the Al-Aqsa Floods operation carried out by the Izz al-Din al-Qassam Martyr Brigades and armed Palestinian factions, another dated October 7, 2023. In a situation that surprised everyone, the Court International Justice announced that the State of South Africa submitted to it, on December 29, 2023, a complaint accusing Israel of having committed acts of genocide, justifying its claim that Israel had violated its stipulated obligations. in the Convention on the Prevention and Punishment of Genocide of 1948, which guarantees the Palestinian people of the Gaza Strip protection against genocide. In two public hearings held at the tribunal's headquarters in The Hague on January 11 and 12, 2024, the tribunal heard South Africa's requests and Israel's pleadings, and delivered its decision on the urgent part of the case on January 26, 2024. He ordered six orders to Israel, including the order that Israel take measures within its capabilities to prevent the commission of acts of genocide stipulated in Article Two of the Convention for the prevention and repression of genocide. The court also ordered Israel to submit a report to the court within a month. on the measures it has taken to implement these orders.
