عقد الامتياز ودوره في حماية الأراضي الفلاحية التابعة للأملاك الخاصة للدولة

الملخص
تهدف هذه الدراسة إلى تسليط الضوء على عقد الامتياز باعتباره احد أهم الآليات القانونية الكفيلة بتوفير العقار الفلاحي التابع للأملاك الخاصة للدولة، من خلال مجموعة من الضوابط، التي يلزم عقد الامتياز بها المستثمرين أصحاب الامتياز، إضافة إلى ما يخول للدولة من بسط رقابتها على العقار محل الامتياز. تم التوصل من خلال هذا البحث إلى مجموعة من النتائج، أهمها ضرورة إعادة النظر في مدة عقد الامتياز، وكذلك ضرورة فرض حد أدنى من الإنتاج . This study aims to shed light on the concession contract as one of the most important legal mechanisms guaranteeing the provision of agricultural real estate belonging to the private property of the state, through a set of controls, by which the concession contract abides the concessionary investors, in addition to what authorizes the state to extend its control over the property subject to the concession. Through this research, a set of results were reached, the most important of which is the necessity to reconsider the term of the concession contract, as well as the necessity to impose a minimum level of production.
