حق الامتياز على الأراضي الفلاحية التابعة للأملاك الخاصة للدولة

الملخص
تهدف هذه الدراسة إلى الكشف عن الامتياز كأهم إصلاح سارعت إليه الجزائر بعد الاستقلال لتحسين وضعية العقار الفلاحي ونظامه القانوني كعقد إداري مؤقت ذو محل معين يتكون من الدولة المانحة وصاحب الامتياز ويخضع لشروط يحددها دفتر شروط تعده السلطة العامة ويتعهد صاحب الامتياز باحترامه،وتتعلق هذه الشروط بالمحل وهو الأراضي الخاصة للدولة،وبصاحب الامتياز الذي يتعين أن يكون شخصا طبيعيا يلتزم بإدارة المستثمرة الفلاحية شخصيا واستغلالها في النشاط المخصص لها ودفع الإتاوة، كما يمكنه رهن العقار وتوريثه والحصول على رخص التعمير. Cette étude vise à détecter l'importance de la franchise précipité à l'Algérie après l'indépendance pour améliorer le statut juridique du foncier agricole comme un contrat administratif temporaire consiste à l’état et au concessionnaire,et sous réserve des conditions relies au fonds,un terrain privé à l'état et au concessionnaire la personne physique engagé à la gestion de l'agriculture personnellement et l'exploitation de son activité et le paiement de la redevance,il peut hypothéquer la propriété,la transmettre et obtenir les permis de reconstruction. this study aims to detect the important of franchise precipitated Algeria after independence to improve the legal status land agricultural as a contract administrative temporary is to the state and dealer ,and subject to the conditions connected to the funds, private land to the state and dealer the natural person committed to the management of agriculture personally and operation of its activity and payment of the fee, it can mortgage property, the transmit and get permits reconstruction
