مبدأ عدم إفلات مجرمي الحرب من العقاب وفعالية القضاء الجنائي في تطبيقه

الملخص
يعتبر مبدأ عدم إفلات مجرمي الحرب من العقاب من أهم ركائز احترام قواعد القانون الدولي الإنساني؛ ولكن العدالة الجنائية عجزت عن تطبيق هذا المبدأ بشكل فعال، فرغم الضمانات القانونية التي نص عليها النظام الأساسي للمحكمة الجنائية الدولية لمنع إفلات المجرمين من العقاب باعتبارها محكمة مكملة لاختصاص المحاكم الجنائية الوطنية إلا أن فعاليتها في مكافحة الجرائم الدولية بما في ذلك جرائم الحرب بقيت محـدودة، وذلك نظرا لتعدد الثغرات التي تضمنها هذا النظام، وموقف بعض الدول المعادي لوجودها أصلا. وفي نفس المضمار، بقي دور المحاكم الجنائية الوطنية ضعيف في تفعيل مبدأ الاختصـاص الجنائي العالمي لمواجهة هذه الجرائم بسبب تعدد معوقاته القانونية والسياسية. The principle of the no impunity of war criminals is considered as one of the most important pillars of respect for the rules of international humanitarian law. However, criminal justice has failed to apply this principle effectively. Despite the legal guarantees stipulated in the Statute of the International Criminal Court to prevent impunity for criminals as a court complementing the jurisdiction of national criminal courts, its effectiveness in combating international crimes, including war crimes, remained limited. Due to the multiple loopholes contained in this system, and the position of some countries hostile to its existence in the first place. In the same field, the role of the national criminal courts remained weak in activating the principle of universal criminal jurisdiction to confront these crimes due to the multiplicity of its legal and political obstacles.
