التصريح بالممتلكات: آلية للوقاية من الفساد

الملخص
الملخص: استحداث منظومة قانونية ومؤسساتية لمكافحة الفساد كان حتمية في الوقت الذي تحركت فيه الدولة الجزائرية، ورؤية المشرع في أن الفساد لا يقتصر -إن حل- على فئة معينة، أو جهاز معين، تحققت في التنصيص على ضرورة تحقيق الوقاية قبل الجزاء. وإصدار القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته كمنظومة متكاملة، انطلقت من آليات الوقاية إلى تجريم مختلف الأفعال التي تجسد جرائم الفساد والعقوبات المقررة لها وقد عد من أهم مظاهر الوقاية ضرورة الأخذ بمبدأ شامل، هو إلزامية التصريح بالممتلكات لكل من يشغل منصبا في الدولة، قبل تولي المنصب وبعده، وليس هذا فحسب، بل وجب اتباع ميكانيزمات وتوفير بيانات، يتوقف عليها صحة الإجراء. كما اعتبر القانون 06-01 كل إخلال بواجب التصريح بالممتلكات فعلا مخالفا لمتطلباته، قد يرتب جزاءات تصل إلى العقوبات السالبة للحرية والغرامات الجزائية، ... الكلمات المفتاحية: التصريح بالممتلكات – الوقاية من الفساد - القانون 06-01. Abstract: The creation of a legal and institutional system to combat corruption was inevitable at a time when the Algerian state moved, and the legislator's vision that corruption is not limited - if a solution - to a specific group, or a specific apparatus, was achieved in the stipulation of the need to achieve prevention before punishment. The issuance of Law 06-01 related to preventing and combating corruption as an integrated system, started from prevention mechanisms to criminalizing various acts that embody corruption crimes and the penalties prescribed for them. Therefore, the obligation to declare property for everyone who occupies a position in the state, considered one of the most important manifestations of prevention the necessity of adopting a comprehensive principle, which is, before and after taking office, and not only that, but it is necessary to follow mechanisms and provide data, on which the validity of the procedure depends. Law 06-01 also considered every breach of the duty to declare property an act contrary to its requirements, which may lead to penalties amounting to deprivation of liberty and penal fines, ...
