الملخص
قادحُ "فساد الوَضع" دراسةٌ في المفهوم والحُجيّة والشّروط ملخَّص هذه الدّراسة تهدفُ إلى الكشف عن معنى من المعاني المعدودة في جملة القوادح المهمّة التي توزن بها الأقيسة الفقهيّة، ويُمكن أن يُعترض بها على سائر الأدلّة الشّرعيّة؛ ألا وهو قادح [فساد الوضع]؛ وقد تمّ إفراده بالبحث نظراً لأهميّته وموقعه بين جملة القوادح المعتبرة عند أهل الأصول والمنطق، وقد تركّز البحثُ على الكشف عن حقيقته وأقسامه وحُجيّة الاعتراض به، وما يصلح أن يكون جواباً عنه في مقام المناظرة والاحتجاج، ولأجل استكمال التصوّرات والمفاهيم؛ فقد أُتبِع البحثُ بجملة من التّطبيقات الفقهيّة المتنوّعة من أجل إيقاف القارئ على أهميّة القادح وأثره في وزن المقاييس الفقهيّة المتنوّعة، وتوصّل البحثُ إلى جملة من النّتائج؛ أهمّها: أنّ القوادح من لوازم البناء السّليم للقياس الفقهيّ التي لا يُمكن الاستغناءُ عنها بحال، وأنّ قادح [فساد الوضع] يُعدّ من أهمّها وأوّليّاتها، وأنّ الاعتراض به على أيّ قياس مُلزمٌ للمُستدلّ، ولا مناص له من الإجابة عنه بما يدفعه أو يُسلّم لخصمه عدم سلامة القياس الذي أورده. defamer of "corruption of the situation" A study in the concept, argument and conditions summary This study aims to reveal the meaning of the enumerated meanings in the sentence of the important triggers with which jurisprudential syllogisms are weighed, and by which it is possible to object to all other legal evidences; It is a defamer [corruption of the situation]; It was singled out for research due to its importance and its position among the list of defamations considered by the people of fundamentals and logic.
