قواعدُ الظّنّ ومُوجّهاتُه في التّشريع الإسلاميّ

الملخص
ملخّص هذا البحثُ يهدف إلى الكشف عن حقيقة الظنّ الذي يكثر استعماله والتّعويلُ عليه في مُختلِف أنحاء التّشريع الإسلاميّ، وعن المُصطلحات ذات الصّلة به، وعن أنواع الظنّ وشروط الاعتماد عليه، ويهدفُ كذلك إلى الكشف عن أهمّ المعاني الكليّة التي جرت على ألسنة الفقهاء مجرى القواعد المُقرّرة، وهي معانٍ يُمكنُ الاحتكامُ إليها في إثبات سلامة الاعتماد على الظنّ، وفي تمييز المُعتبر منه عن غيره، وفي الوقوف على ما ينبغي تقديمُه عندما تتعارض مُقتضياتُ الظّنون في مقام الامتثال، واعتمد البحثُ منهجَ الاستقراء الأغلبيّ في تجميع تلك المعاني الكليّة، والمنهجَ التّحليليّ في الإفادة من تلك المعاني في التّأصيل للظنّ المُعتبر وضبط مسالكه وشروط العمل به، وتوصّل البحثُ إلى جُملة من النّتائج؛ أبرزُها:ـ أنّ العمل بالظنّ المُعتبر محلّ وفاق بين فقهاء الشّريعة، والعبارات المرويّة عن بعض الأئمةّ في رفض العمل بالظنّ محمولةٌ على الظنون التي يرفضها الشّرع، ولا يشهدُ لها الواقع، وأنّ بين العمل بالظنّ والوهم مسافةً قد تتّسع وقد تضيق، وعلى المُجتهد أن يعتبر ميزان الشّرع في تخليص ما ينبغي اتّباعُه والبناءُ على وَفقه من الظّنون من غيره، وأنّ للظنّ قواعدَ كليّة تُساعد في ضبطه وتوجيه العمل به في مقام الاستنباط وفي مقام الاجتهاد، وقد أتى البحثُ على جملة ممّا أدركه من ذلك. Abstract This research aims to reveal the reality of conjecture, which is frequently used and relied upon in various parts of Islamic legislation, and the terms related to it, and its types and conditions for relying on it. It can be resorted to in proving the validity of reliance on conjecture, and in distinguishing the considered conjecture from others, and in standing on what should be presented when the requirements of conjecture conflict in the place of compliance. Rooting the considered suspicion and adjusting its paths and conditions for working with it, and reaching a number of results; The most prominent of which are: that acting by conjecture is considered a matter of agreement between the jurists of the Sharia, and the narrated expressions of some imams in refusing to act by conjecture are carried on conjectures that are rejected by the Sharia, and are not supported by consideration, and reality does not testify to them, and that between acting by conjecture and delusion there is a distance that may widen or narrow, and on The mujtahid is to consider the balance of the Sharia in purifying what should be followed and building on its basis from suspicions from others, and that conjecture has universal rules that help in controlling it and directing action with it in the place of deduction and in the place of ijtihad.
