الملخص
التّعليل بالثّمنيّة وأثرُه في أحكام العملات الافتراضيّة مُلخّص: هذا البحثُ يتناول إشكاليّة تثمين العملات الافتراضية، وذلك انطلاقاً من مسألة التّعليل بالثّمنية المشهورة في كتب الأصول والفقه، ومن أجل الكشف عن موقف الفقهاء المعاصرين في المسألة احتجنا إلى وقفة مع آراء الفقهاء فيما استجدّ عبر القرون الماضية من نقود مسكوكة من غير النّقدين؛ لنصل من خلال ذلك إلى إمكانية تعميم وصف الثّمنيّة المُعلّل به ليشمل كلّ ما يجدّ في دنيا النّاس من عُملات يتواطؤون على اعتمادها مرجعاً فيما بينهم لتقييم ما بين أيديهم من مُختلف الأموال؛ وتوسّل البحثُ بالمنهج الاستقرائّي في تجميع مادّته العلميّة، وبالمنهج التّحليليّ المُقارن في الإفادة من تلك المادّة في محاولة بلوغ مُقاربة فقهيّة بشأن حكم العملات الافتراضيّة؛ وتوصّل إلى نتائج أبرزها: ـ أنّ أقرب علّة لمقصود الشّارع يُمكن أن يُعلّل بها تحريم الرّبا في النّقدين:ـ هي كونُ كلّ منهما أثماناً للأشياء، وهي علّةٌ مُطلقة، ويُمكنها أن تتحقّق في كلّ ما يتعارف النّاس على تثمينه في أيّ عصر من العصور من غير ارتفاعها عن الذّهب والفضّة لكونها فيهما علّة أصليّة ذاتيّة؛ وأنّه لا مانع شرعاً من اعتبار العُملات الافتراضيّة أثماناً إذا تحقّقت فيها علّة الحكم بشروط؛ أهمّها:ـ المصداقيّة العُرفيّة والقانونيّة والاستقرارُ القيميّ لها، وهو ما لم يتحقّق لحدّ السّاعة في أيّ من العملات الافتراضية الشّائعة. كلمات مفتاحيّة: 1-علّة 2- ثمنيّة 3- عملة 4- نقد 5- افتراضيّة Explantation of the Price and its impact in the provisions of currencies Default Abstract This research deals with the problem of valuation of virtual currencies, based on the issue of reasoning with the well-known price in the books of assets and jurisprudence, and in order to reveal the position of contemporary jurists in this matter, we needed a pause with the opinions of jurists regarding new coins minted from non-cashers over the past centuries; Through this, we reach the possibility of generalizing the justified price description to include all the currencies that people find in the world that they conspire to adopt as a reference among themselves to evaluate the various funds in their hands; The research used the inductive approach in collecting its scientific material, and the comparative analytical approach in benefiting from that material in an attempt to reach a jurisprudential approach regarding the rule of virtual currencies. And he reached results, the most prominent of which are: - That the closest reason for the intention of the Law can be justified by which the prohibition of usury in cash is justified: - It is the fact that each of them are prices for things, and it is an absolute reason, and it can be achieved in everything that people know to value in any age without its height. About gold and silver because they have an original and intrinsic cause; And that there is no legal objection to considering virtual currencies as prices if the reason for ruling with conditions is fulfilled in them; The most important of them: customary and legal credibility and value stability, which has not been achieved so far in any of the common virtual currencies.
