التدخل الانساني بين التطبيق والتضييق

الملخص
تنص المادة 2/7 من ميثاق الأمم المتحدة على :" ليس في هذا الميثاق ما يسمح للأمم المتحدة أن تتدخل في الشؤون التي تكون من صميم السلطان الداخلي لدولة ما ، وليس فيه ما يقتضي للأعضاء أن يعرضوا مثل هذه المسائل لأن تحل بحكم هذا الميثاق ، على أن هذا المبدأ لا يخل بتطبيق تدابير القمع الواردة في الفصل السابع " ، يفهم من نص هذه المادة عدم الجواز للأمم المتحدة بالتدخل في الأمور التي تدخل في صميم الاختصاص الداخلي للدول الأعضاء بها ، لكن المتتبع للأوضاع السياسية يرى غير ذلك والدارس للقانون يفهم عكس ذلك، حيث تهدف دراستنا إلى قراءة هذه المادة وتفصيلها لرفع كل الالتباسات حولها. و من بين أهم النتائج المتوصل إليها أن هذا النص يتصف بالغموض وذلك من حيث عدم وضع حد فاصل ما بين ما هو يدخل في نطاق الاختصاص الدولي وبين ما هو من الاختصاص الداخلي، ورغم أن نص المادة 2/7 من الميثاق يحظر تدخل الأمم المتحدة في الشؤون الداخلية للدول الأعضاء ، إلا أن هذا الحظر لا يمنع الأمم المتحدة من ذلك. Abstract: Article 2/7 of the Charter of the United Nations states: “Nothing in this Charter permits the United Nations to interfere in matters which are within the internal jurisdiction of a state, and nothing in it requires members to submit such questions to be resolved by virtue of this Charter, on This principle does not prejudice the application of the repressive measures mentioned in Chapter VII“ , It is understood from the text of this article that the United Nations is not allowed to interfere in matters that fall within the core internal jurisdiction of its member states. Our study aims to read and detail this article to remove all ambiguities around it. Among the most important conclusions reached is that this text is characterized by ambiguity in that it does not set a line between what falls within the scope of international jurisdiction and what is within the internal jurisdiction, although the text of Article 2/7 of the Charter prohibits the United Nations from interfering in the internal affairs of states but this ban does not prevent the United Nations from doing so
