أهمية الصّياغة في تحديد مضمون الدّستور

الملخص
إن تحقيق دستور واضح ومتكامل لا يمكن أن يكون دون مراعاة الصياغة، كوعاء تعبيري ولغوي يحتويه، والذي يتيح فهما وإدراكا صحيحين لمضمونه، وما يمكن أن يحققه لاحقا من توازن في الجوانب الشكلية والموضوعية والمنهجية، وانعكاسه على المؤسسات الدستورية في الدولة، انطلاقا من تحقيق الانسجام بينها واجتناب أي وجه من أوجه الاختلاف، التي يمكن أن تَنتُج عن عدم فهم محتوى الدستور، وخلاف ذلك ما تحققه صياغة الدستور المُحكَمة من تعبير سليم عن الإرادة العامة، واعتبارها بالتالي مظهرا من مظاهر ممارسة السيادة، ببعديها الداخلي والخارجي. Abstract: An explicit and integrated constitution could not be actualized without observing and respecting its formulation as its expressive and linguistic basis providing a true understanding and awareness of its content. A content that, subsequently, would achieve a balance in the formal, objective and methodical aspects of the constitution and reflect on the constitutional institutions of state judging from realizing a harmony among these institutions; therefore, abstaining from any kind of disharmony. This latter can result from a misunderstanding of the content of the constitution. Otherwise, a coherently formulated constitution reflects a sound common will regarded, thereby, as a manifestation of sovereignty in its internal and external dimensions.
