(بيع ما ليس عندك) في المذهب المالكيselling What You Don't Own According To The Maliki School Of Thought

الملخص

: تتناول هذه الدراسة موقف المذهب المالكي من مسألة بيع ما ليس عندك، فقد ورد فيها حديث في معناها ومع هذا كان للمالكية مواقف متعددة، حتى نسب إلى الامام مالك في العتبية ما يفيد الجواز، وهو إشكال قمنا بمعالجته بالعودة الى المدونات الأصلية في المذهب، ووصلنا فيه إلى أم ملكية المبيع شرط ذكرته أصول المالكية، وهي قاعدة أغلبية لها مستثنياتها، ولها توابعها من العلل والحكم المنوطة بها، لذلك ثبت عن الإمام مالك تصحيحه لصور من البيوع تخلو من ملكية المبيع السابقة على العقد بسبب قلّة الغرر فيها، أو ضمان القدرة على التسليم، وأن منع المبيع لا تعود لعدم التملّك بذاته، وإنما لأوصاف ذاتية هي خوف الاستحقاق، والعينة، وعدم القدرة على تخليص المبيع، وعدم قابلية المحلّ للتملك، وعدم إجازة الغير في بيع الفضولي. الكلمات المفتاحية: بيع ما ليس عندك، المالكية، الملكية، الغرر. Abstact This study deals with the position of the Maliki school of thought on the issue of selling what you don't have, because a hadith was mentioned there in its meaning. However, the Malikis had multiple attitudes, until Imam Malik be attributed to Imam Malik in al-Atabiyah which indicates the lawfulness, a problem we have dealt with by returning to the original records in the doctrine, and we have arrived at it. A mother of the property sold is a condition mentioned by the assets of the owners, and it is a majority rule which has its exceptions, and it has its consequences of evils and the decision entrusted to it. And that the prohibition of the sale is not due to a lack of ownership per se, but rather to subjective characteristics such as fear of maturity, sample, inability to redeem the item sold, inability of the store to own property and lack of authorization for others to sell the curious.
