الملخص

ملخص: تكمن أهمية دراسة سلطة الضبط الإداري للوزير الأول في رفع اللبس الناتج عن الخلط بينها وبين باقي السلطات الأخرى الممنوحة له وفق التشريع الجزائري، وتوضيح أهمية إسناد العديد من الصلاحيات له في الحفاظ على النظام العام وحمايته من الانهيار، التشتت والفوضى، وقد تزايدت أهمية الضبط الإداري واتسعت مجالاته وفقا للتطورات والأزمات الحاصلة على النطاق العالمي والوطني، وبالتالي فتسليط الضوء على أهدافه الكلاسيكية لم يعد مجديا دون تدعيمها بالأهداف الحديثة خاصة إذا تمكنا من تحديد علاقتها المباشرة وغير المباشرة بسلطات الوزير الأول. ولأن الضبط الإداري نشاط سلبي يهدف إلى تقييد بعض السلوكات الفردية والجماعية في الظروف العادية والاستثنائية تحقيقا للمصلحة العامة، في ظل تحقيق مبادئ الإستقرار والطمأنينة، وجب تبرير ذلك بتوفير أسباب الحكم الراشد وتنفيذ مبادئ الحوكمة والمسؤولية الاجتماعية، لذا سعينا من خلال هذه الورقة البحثية إلى توضيح كيفية ممارسته وحدوده من طرف الحكومة ممثلة في وزيرها الأول كثاني سلطة مفوضة لممارسة الضبط الإداري بعد رئيس الجمهورية مباشرة. كلمات مفتاحية: الضبط الإداري، الوزير الأول، النظام العام. Abstract: The importance of studying the First Minister's administrative control authority is to eliminate confusion with other powers conferred upon him in accordance with Algerian legislation, and to clarify the importance of having many powers to preserve public order and protect it from collapse, Fragmentation and chaos. Management control has become increasingly important and has expanded in relation to global and national developments and crises. Thus, highlighting his classical goals is no longer feasible without supporting them with modern goals, especially if we can determine their direct and indirect relationship with the powers of the Chief Minister. Because administrative control is a passive activity aimed at restricting certain individual and collective behaviour in normal and exceptional circumstances in the public interest by providing reasons for good governance and implementing the principles of governance and social responsibility ". We sought to clarify and so through this paper how it is exercised and limited by the Government represented in its first Minister as the second delegated authority to exercise administrative control power immediately after the President of the Republic.
