شهادة التعمير و منازعاتها وفق اخر التعديلات القانونية

الملخص
يعتبر حق البناء من الحقوق المرتبطة بحق الملكية العقارية، غير أن المشرع الجزائري قد نص على مجموعة من الضوابط تحكم هذا الأخير وتقيده للحد من ظاهرة البناء الفوضوي الذي يخلق نسيج عمراني غير لائق. وتعتبر الرخص والشهادات الإدارية المنصوص عليها قانونا، من أهم وسائل الرقابة الممنوحة للإدارة في المجال العمراني، غير انه ونظرا لما قد تشكله هذه الأخيرة من قيد على المالك، فقد استحدث المشرع الجزائري شهادة توضيحية يمكن للمعني بالبناء طلبها لمعرفة وضعية عقاره بدقة وذلك من خلال تحديد حقوق البناء عليه والارتفاقات التي تثقله، والمتمثلة أساسا في ارتفاقات التعمير، سواء المقيدة أو المانعة للبناء، وهذا ليكون على بينة من أمره، تعرف بشهادة التعمير. وإن كان طلب الحصول على شهادة التعمير وعلى خلاف غيرها من عقود التعمير الأخرى، هو أمر اختياري إلا أن المشرع الجزائري قد خول للمعني بها حق الطعن فيها في حال عدم رضاه عن محتواها أو سكوت الإدارة عن الرد عن طلبه بشأنها، نظرا لأهمية هذه الأخيرة و التي قد تكون أساسا تبنى عليه باقي الرخص لا سيما رخصة التجزئة و رخصة البناء. وهو ما يقودنا لطرح الإشكالية التالية: ماهية الإجراءات القانونية التي تحكم شهادة التعمير وما طبيعة المنازعات المتعلقة بها؟ Abstract: The right to build is one of the rights associated with the right of ownership, but the Algerian legislator has stipulated a set of controls that govern the latter and restrict it to limit the phenomenon of chaotic construction that creates an inappropriate urban . The administrative licenses and certificates stipulated by law are considered one of the most important means of control granted to the administration in the urban field. However, given the restrictions that the latter may pose to the owner, the Algerian legislator has created two explanatory certificates that the building owner can request to know the exact condition of his property by specifying the building rights on it and the easements that Its weight, which is mainly represented by the urbanism easements that restrict and prevent construction, and this is so that he is aware of his order. Know the certificate of urbanism where the law gives him the right to challenge it in the event he is not satisfied with its content or the administration is silent about responding to his request regarding it due to the importance of the latter, which may be the basis on which the rest of the licenses are built.
