بعض المشاكل التي واجهها التحكيم البترولي بالدول العربية Some Problems That Faced By Petroleum Arbitration In The Arab Countries

الملخص
إن حل منازعات عقود البترول عبر نظام التحكيم لم يكن بالأمر السهل، حيث أن الإنطلاق بالعملية التحكيمية للوصول بها إلى قرار تحكيمي يتمتع بالفعالية وينفد من قبل الطرف الصادر ضده قد يواجه بمشاكل عدة، منها ما يعود إلى إخضاع عقود البترول لأحكام القانون الدولي العام وهو ما يطلق عليه بتدويل النزاع وهو ما حدث في العديد من قضايا التحكيم العربية، كما قد تظهر بعض المشاكل بعد الإنتهاء من تشكيل هيئة التحكيم، أبرزها مشكلة مدى حيادية وإستقلالية المحكمين الأجانب. الأمر الذي قد يؤدي إلى إصدار أحكام لا تهتم بمصالح وحقوق الدول العربية المنتجة للبترول. Resolving oil contract disputes through the arbitration system was not an easy task, Because starting the arbitration process to reach an arbitral decision to be implemented by the party against whom it was issued may encounter several problems, including what is related to the subjection of petroleum contracts to the provisions of public international law, which is called the internationalization of the dispute, Which is what happened in many arbitration cases for Arab countries, Some problems may also arise after the formation of the arbitral tribunal is completed, The most prominent of these is the problem of the extent of impartiality and independence of foreign arbitrators, Which may lead to the issuance of rulings that do not care about the interests and rights of Arab oil-producing countries.
