الملخص

لقد تجاوب المشرع الجزائري في قانون المحروقات الجديد لسنة 2019 مع المعطيات الجديدة التي فرضتها الممارسة العملية بخصوص الفصل في الخلافات الناتجة عن الإستثمارات في مجال البترول بالنص على اللجوء إلى طريق تسوية النزاعات بالتراضي إلى جانب التحكيم الدولي لحل المنازعات التي تطرأ بصدد عقود البترول والغاز باعتبارها الصناعة الغالبة في الجزائر. وهي الوسائل التي يلجأ إليها أطراف النزاع البترولي عوضا عن القضاء الوطني الذي أصبح إختصاصه مسألة غير واردة في الوقت الحالي، لأن السيادة لم يعد لها معنى في ظل العولمة وإقتصاد السوق، كما ويتم اللجوء إليها أيضا للمحافظة على بقاء العلاقات ودية حينما يتعلق الأمر بالخلافات المرتبطة ببعض القطاعات الحساسة كما الحال بالنسبة لمجال البترول والطاقة عموما. In the new hydrocarbons' law of 2019, the Algerian legislator has responded to the new data imposed by practical practice regarding the adjudication of disputes arising from investments in the field of petroleum By providing for resorting to the method of settling disputes by mutual consent in addition to international arbitration to resolve disputes that arise in connection with oil and gas contracts, given that it is the predominant industry in Algeria. These are the means that the parties to the oil dispute resort to instead of the national judiciary, whose jurisdiction has become an issue that is out of the question at the present time, Because sovereignty no longer has meaning in light of globalization and the market economy, It is also used to maintain friendly relations when it comes to disputes related to some sensitive sectors, as is the case in the field of oil and energy in general.
