الملخص
ملخص تعتبر الجريمة الجمركية تعدٍ خطير، يهدد الاقتصاد الوطني، ومقدرات الوطن، لذلك خصتها التشريعات بعقوبات خاصة في قانون الجمارك، وخرج في تجريمها عن القواعد المألوفة والمعروفة في قانون العقوبات. ومن ذلك حدد لها وسائل إثبات بحجية خاصة، وقلب عبء الإثبات من المدعي إلى المدعى عليه، لأن القانون يبحث عن الموازنة بين مصالح متضاربة، يرجح دائما المصلحة العامة. Customs crime is considered a serious crime that threatens the national economy and the country's capabilities, this is why the legislation provides special penalties in the customs code, and the criminalization thereof departs from the usual and known rules in the penal code. It thus identified special means of proof and shifted the burden of proof from the plaintiff to the defendant, because the law seeks to balance conflicting interests, always preferring the public interest.
