الملخص
يقوم السجل العقاري على كل من المسح العام للأراضي ومجموع البطاقات العقارية التي ينشؤها المحافظ العقاري تكوينا لها، ويظهر في ذلك بعدين، البعد الشكلي في كل من وثائق مسح الأراضي والبطاقات العقارية، والبعد القانوني الموضوعي في قيد الحقوق وحفظها وتداولها. ويبدو أن لطبيعة وثائق المسح أثر هام في ذلك، لكن طبيعة هذا الأثر التي يستمدها من طبيعة وثائق المسح في حد ذاتها، تتجاذبها مواقف المشرع، وما ينبغي أن تكون عليه حسب ما يراه الفقه القانونيThe land registry is based on both the general survey of land and land cards created by the real estate conservator, and it shows in two dimensions, the formal dimension in land registry documents and real estate cards, and the objective legal dimension in the registration, preservation and circulation of rights. and it seems that the nature of the survey documents has an important impact on this, but the nature of this effect, which derives from the nature of the survey documents, is attracted by the positions of the legislator, and what it should be according to the opinion of legal jurisprudence.
