الملخص
لقد أصبحت حركة العمران مقيدة بمقتضيات حماية البيئة، إذ لم تعد التشريعات البيئية تقتصر لوحدها على هذه الحماية، بل حتى التشريعات الخاصة بالعمران أو ذات الصلة به، ضمنت أحكامها مراعاة الجانب البيئي،، عن طريق وسائل قانونية محددة، بما يضمن حماية البيئة والمحافظة عليها، خاصة في ظل انتشار حركة التوسع العمراني والبناء غير الشرعي. وعليه فإن موضوع قواعد التهيئة والتعمير في تحقيق التوازن بين حماية البيئة والتنمية المستدامة هو موضوع حساس يقتضي مراعاة هذه القواعد للموازنة بين عمليات التهيئة والتعمير قصد الوصول إلى تنمية عمرانية مستدامة. The movement of urbanization has become restricted by the requirements of environmental protection, as the environmental legislation is no longer limited to this protection alone, but even the legislation related to or related to urbanization, its provisions guaranteeing the consideration of the environmental aspect, through specific legal means, to ensure the protection and preservation of the environment, Especially in light of the spread of urban expansion and illegal construction. Accordingly, the issue of the rules of preparation and reconstruction in achieving a balance between environmental protection and sustainable development is a sensitive topic that requires observance of these rules to balance the processes of development and reconstruction in order to reach sustainable urban development.
