التعاون المشترك بين البلديات وفقا لقانون البلدية رقم 11/10

الملخص
يعتبر التعاون المشترك بين البلديات آلية تضامنية فعالة لبناء رؤية تنموية مشتركة بين البلديات، تتم عن طريق تجميع الجهود وتثمين الموارد والإمكانيات المحلية. أطر المشرع الجزائري هذا الأسلوب من خلال قوانين البلدية المتعاقبة، أخرها قانون البلدية رقم 11/10، وذلك لتمكين هذه الأخيرة من إنجاز مشاريع مشتركة في إطار عقود أو اتفاقيات وفقا لشروط وضوابط محددة. لكن بالرغم من هذا التكريس القانوني، إلا أن الواقع الميداني يظهر ضعف الممارسة، الأمر الراجع لإعتبارات عديدة، خاصة منها قصور الإطار القانوني والتنظيمي لهذه الصيغة، ما يستوجب إذن إعادة النظر في خاصة قانون البلدية الحالي. Inter-municipal cooperation is an effective solidarity mechanism, for building a common development vision between municipalities, which is achieved by pooling efforts and valuing local resources and capabilities. The Algerian legislator framed this method through successive municipal laws, the latest of which was Municipal Law No. 11/10, in order to enable the latter to implement joint projects within the framework of contracts or agreements in accordance with specific conditions and controls. However, despite this legal devotion, the field reality shows the weakness of the practice, which is due to many considerations, especially the lack of the legal and regulatory framework for this formula, which necessitates a review of the current municipal law which necessitates a review of the current municipal law.
