العقد التوثيقي الإلكتروني كآلية لعصرنة مهنة التوثيق "دراسة مقارنة"

الملخص
غزت التكنولوجيا الحديثة مختلف المجالات بما فيها قطاع التوثيق، وأوجدت مفاهيم جديدة نافست المفاهيم التقليدية منها العقد التوثيقي الإلكتروني بنوعيه، سواء المحرر على دعامة إلكترونية أو المبرم عن بعد. الأمر الذي يقتضي ضرورة البحث عن مدى خصوصية العقد التوثيقي الإلكتروني ودوره كأداة لعصرنة مهنة التوثيق، خصوصا لو علمنا أنه لا يغير في الطبيعة القانونية للتصرفات التي تفرغ في قالبه وتصبغ بطابع الرسمية، بل يؤدي لنفس الأهداف والنتائج مادام أنها ستجرى أمام موثق باعتباره شاهد ممتاز، ولقد أقرت التشريعات المقارنة لا سيما التشريع الفرنسي بالعقد التوثيقي الإلكتروني بنوعيه، أما المشرع الجزائري فلم يقر إلا بالعقد التوثيقي المبرم على دعامة إلكترونية، ولو أن الموثقين غير متحمسين له أمام نقص مؤهلات التجسيد و كثرة عوائق التنفيذ. Technological revolution has significantly impacted many domains including the notary sector and mainly the electronic notarial act which emerged in the form of an Electronic version and distance acts. In this regard, the specificities of the electronic notarial act should be studied in the scope of the key role this document plays in the profession, it does not alter the official nature of the legal measures it implies but rather ensures the motives and the results of this proceeding before the notary who is the best witness of its efficiency. Unlike the French legislator which adopted the electronic notarial act in both its forms, the Algerian legislation relies solely on the electronic version of the contracts as the notaries are reluctant considering the difficulties to embody and apply this means.
