" الاجتهاد وجدل الاستشراق:نقد وائل حلاق لمقولة "غلق باب الاجتهاد

الملخص
تهدف هذه المقالة إلى كشف الآليات المنهجية والابستمولوجية التي انطلق منها وائل حلاق لدحض اطروحات الفكر الاستشراقي من داخل معاقله ، باعتباره أداة من أدوات الاستعمار لفرض سيطرته على الشرق، ومن ذلك وقوفُه على مبدأ الفصل الذي أقامه الفكر الاستشراقي بين العلوم الإسلامية (الفقه والأصول)، وبين المجتمع الإسلامي، من خلال نَفْيِ العلاقة التفاعلية بين الفكر والواقع؛ للوصول إلى خلاصة مفادها هامشية الفكر الإسلامي وعدم اتصاله بالواقع الاجتماعي،والادعاء بغلقَ باب الاجتهاد والنظر، مما أوقع المجتمع الإسلامي في دوّامة من التخلف والتقليد، والتي لم يستفق منها إلا بعد صدمة الحداثة، التي أثارت فيه الأسئلة المحرجة إزاء الذات والتاريخ، وفتحت أعينه على منجزات الحضارة الغربية المتقدمة. This article aims to uncover the methodological and epistemological mechanisms that Wael Hallaq launched to refute the theses of Orientalist thought from within its strongholds, as it is a tool of colonialism to impose its control on the East, including his standing on the principle of separation established by Orientalist thought between Islamic sciences (jurisprudence and fundamentals), and between Islamic society, by denying the interactive relationship between thought and reality; To reach a conclusion that the marginalization of Islamic thought and its lack of connection with social reality, and the claim that the door of diligence and consideration is closed, which has plunged the Islamic community into a cycle of backwardness and tradition, from which it did not recover until after the shock of modernity, which raised embarrassing questions about self and history, and opened its eyes to the achievements Advanced western civilization.
