أصول النّظر الإسلامي ( المبادئ العشرة )

الملخص
لكلّ علم مبادئه ومصادره وقواعده، بها تربط الفروع بالأصول والجديد بالقديم، فكلّ علم يحتاج إلى أصول تضبطه وقواعد تنظمه، ولكن وضع هذه الأصول والقواعد وتمييزها عن غيرها هو نابع وناتج عن تصوّر معيّن ومنظومة فكرية واضحة، هو المعبّر عنها بالمنطق أو العقيدة، فالمنظومة الفكرية المتبنّاة هي التّي ترسم معالم الأصول المتبعة والقواعد المفعّلة، فمنطق الإنسان النّظري ومبناه الفكري هو الذّي يرسم توجهاته التقعيدية التأصيلية، فهو الموجّه للجزء القانوني العملي فيه، فقبل أصول الفقه أو أصول القانون، هناك منطق الأصول أو فلسفة القانون، وهذا ما سنحاول بيانه في هذا المقال، وبيان ماهية أصول النّظر ومبادئ الفكر في التشريع الإسلامي . Every science has its principles, sources, and rules, by which branches are linked to the origins and the new to the old. Every science needs assets that control it and rules that regulate it. However, setting these principles and rules and distinguishing them from others is the result of a specific conception and a clear intellectual system, which is expressed by logic or belief, so the intellectual system adopted It is the one that draws the features of the principles followed and the rules that are in force. The theoretical logic of man and his intellectual structure is the one who draws his original fundamental orientations. He guides the practical legal part in it. Before the principles of jurisprudence or the principles of law, there is the logic of assets or the philosophy of law. And an explanation of the nature of the principles of thought and the principles of thought in Islamic legislation.
