الملخص: الالتزام بضمان السلامة التزام حديث النشأة ، ظهر نتيجة اجتهادات القضاء الفرنسي مدعما من طرف الفقه، هذا الالتزام قائم على عاتق البائع المحترف لصالح المستهلك الإلكتروني حيث يهدف هذا الالتزام إلى توفير الأمان وحصول المستهلك على منتج أو خدمة لا تنطوي على خطورة قد تمس سلامة جسمه وصحته، أمام عجز قواعد الضمان التقليدية تغطية المخاطر التي تسببها المنتجات العالية التعقيد والخطيرة التي واكبت التطور التكنولوجي والتي يصعب على المستهلك التعامل معها في مواجهة المتدخل، فالالتزام بضمان السلامة يتخطى العيوب التي تسببها المنتجات ليشمل الأضرار التي تسببها هذه المنتجات بسبب تطورها فهو أسلوب وقائي وعلاجي لكل ضحايا عيوب المنتجات والخدمات المقدمة الكترونيا فالالتزام بضمان السلامة يضمن للمستهلك التعاقد الكترونيا. Abstract: The commitment to ensure safety is a newly established obligation, as a result of the jurisprudence of the French judiciary supported by jurisprudence, this obligation is based on the professional seller for the benefit of the electronic consumer, where this obligation aims to provide security and the consumer's access to a product or service that does not involve a risk that may affect the safety and health of his body, in the face of the inability of traditional security rules to cover the risks caused by highly complex and dangerous products that have accompanied technological development and which are difficult for the consumer to deal with in the face of interference, the obligation By ensuring safety that goes beyond the defects caused by the products to include the damage caused by these products due to their development, it is a preventive and therapeutic method for all victims of defects of products and services provided electronically, the obligation to ensure safety guarantees the consumer contract electronically.
