اللقاحات المبتكرة... أي ضمانات وأي حدود للمسؤولية

الملخص
لا يخفى على أحد أهمية التطعيمات الصحية ودورها في الوقاية من الأمراض وحفظ الصحة العامة، حتى أضحت التزاما قانونيا على كافة الأفراد والدول. ولا شك أن انتشار عديد الفيروسات والأمراض حديثا تقتضي معالجة الجوانب القانونية لهذا الموضوع لأهميته. إذ ستنصب هذه الدراسة أساسا على بيان الضمانات القانونية لتقديم اللقاحات، فضلا عن المسؤولية المدنية المترتبة عن الأضرار والمخاطر الناجمة عنها. وذلك في ظل الترقب والمخاوف من الشروع في عمليات التلقيح ضد مرض كوفيد 19. حيث ستنحصر الدراسة في قسمين رئيسيين؛ الأول يتناول الإطار القانوني لاستخدامات التطعيمات المبتكرة وضماناتها. في حين يتطرق القسم الثاني لحدود المسؤولية المدنية الناجمة عن أضرارها أو مخاطرها. ضمن دراسة تحليلية نقدية. وتروم هذه الورقة البحثية الوصول إلى نتائج علمية واقعية تتمثل في عدم إلزامية التلقيح كأصل عام، ما لم تلزم بذلك الدولة حفظا للصحة والسلامة العامة. إضافة إلى ضرورة إحاطة اللقاحات بعدة ضمانات طبية مهنية وأخرى قانونية. فضلا عن المسؤولية المدنية القائمة على الضرر في ظل إلزامية التلقيح من قبل الدولة. The importance of health vaccinations and their role in preventing diseases and preserving public health is no secret, until they have become a legal obligation on all individuals and countries. There is no doubt that the recent spread of many viruses and diseases requires addressing the legal aspects of this issue due to its importance. As this study will mainly focus on explaining the legal guarantees for providing vaccines, as well as the civil liability arising from the damages and the risks resulting from them. In light of anticipation and fears of initiating vaccinations against Covid 19 disease, the study will be limited to two main parts; The first deals with the legal framework for the uses and guarantees of innovative vaccines. While the second section deals with the limits of civil liability resulting from its damages or risks. Within a critical analysis study. This research paper aims to reach realistic scientific results represented in not compulsory vaccination as a general rule, unless the state obliges to do so in order to preserve public health and safety. In addition to the necessity to surround the vaccines with several professional medical and legal guarantees. As well as civil liability based on damage under mandatory vaccination by the state.
