توزيع الكنوز والمعادن في الفقه الإسلامي Treasures And Metal Distribution In Islamic Jurisprudence

الملخص
يحاول هذا البحث أن يكشف عن وجهة نظر الفقه الإسلامي في كيفية توزيع الكنوز والمعادن المكتشفة من قبل الأفراد، وبيان سبل تملكها. وقد كشف البحث عن اختلاف النظر الفقهي إلى طبيعة الكنوز المكتشفة والاتفاق على اعتبار غلبة الظن المرجع في بيان حكمها. وقد كشف هذا البحث أيضا عن تقسيمات متعددة للمعادن مع بيان ما يترتب على تقسيمها من أحكام فقهية، كما كشف عن أن دلالة الظهور في تقسيم المعادن باعتبار ظهورها ليست هي ما يتبادر إلى الذهن من دلالة اللفظ على قرب المعدن من ظاهر الأرض وعدم الحاجة في البحث عنه إلى جهد كبير، بل إن ظهور المعدن يتعلق ببروز طبيعة المعدن وعدم حاجته إلى معالجات من أجل إبراز حقيقته. This research tries to showcase the view of Islamic jurisprudence regarding the distribution of treasures and minerals discovered by individuals. The research also discusses the different ways of owning these treasures and minerals. The current research reveals several categorizations of minerals, and explains the implications of categorizing the different types of minerals as far as the Islamic jurisprudence is concerned. The research shows that the significance of emergence in categorizing minerals is not what is often understood from the term ' emergence'. The emergence of a given mineral suggests that the mineral is near and easily seen on earth, and looking for it does not require hard efforts. The emergence of a mineral is related to the visibility of the nature of the mineral as well as the mineral not being in need to modifications in order to understand its nature.
