الملخص
يحاول هذا البحث أن يستكشف الأثر الذي يمكن أن تتركه جائحة كورونا على أحكام الإجارة، من حيث إمكان الفسخ، أو العودة بالنقص الحاصل من عدم القدرة على تحصيل منفعة المعقود عليه في الإجارة، وقد توصل إلى نتائج منها: أن فيروس كورونا لا يمكن أن يعتبر جائحة مؤثرة في عقد الإجارة إلا إذا صاحبته إجراءات احترازية معينة تفرضها الدولة، كما رجح حصر تأثير هذه الجائحة في نقص الأجرة بدل اللجوء إلى الفسخ؛ لما يمكن أن يتبعه من إضرار المستأجر بما لا ينفع المؤجر. This research attempts to explore the effect that the Corona epidemic can have on the terms of the lease, in terms of the possibility of annulment, or return in something of the fare with a lack of inability to collect the benefit entrusted to him in the lease, and has the results that were reached, Including: that the Coronavirus cannot be considered a pandemic on the lease unless it is accompanied by certain preventive measures imposed by the state, and the impact of this epidemic is likely to be limited to a lack of wages instead of resorting to annulment; Because it can be followed by hurting the tenant without benefiting the landlord.
