دور المحكمة الإتحادية العليا في العراق في حماية الإختصاصات المالية الدستورية

الملخص
يبيّن البحث مدلول الإختصاصات المالية في نطاق التوزيع الدستوري لإختصاصات السلطات الإتحادية والأقاليم والمحافظات غير المنتظمة في إقليم في الدستور العراقي لسنة 2005. كما ويتناول الإطار الدستوري للمحكمة الإتحادية العليا في العراق من ناحية تأسيسها وتكوينها ومهامها والإختصاصات الموكلة إليها. ويركز بصفة خاصة على دراسة تطبيقاتها المتعلقة بحماية الإختصاصات المالية من أي تجاوز، سواء أكان من جانب السلطات الاتحادية أم سلطات الأقاليم أم سلطات المحافظات غير المنتظمة في إقليم، وذلك في ضوء رقابتها على دستورية القوانين، أو تفسيرها لأحكام الدستور والأنظمة النافذة، أو فصلها في المنازعات الناشئة عن ممارسة السلطات المذكورة لهذه الإختصاصات. Abstract: The research shows the significance of the financial competencies within the scope of the constitutional distribution of the powers of the federal authorities, the regions and governorates that are not organized in a region in the Iraqi constitution for the year 2005. It also deals with the constitutional framework of the Federal Supreme Court in Iraq in terms of its establishment, composition, tasks and the competencies assigned to it. It focuses in particular on studying its applications related to the protection of financial competencies from any abuse, whether on the part of the federal authorities, regional authorities, or governorate authorities that are not organized in a region, in light of their control over the constitutionality of laws, their interpretation of the provisions of the constitution and the regulations in force, or their separation in disputes Arising from the aforementioned authorities' exercise of these powers.
