الملخص
يتمحور موضوع المقال حول استثمار أموال الطفل عن طريق المساهمة في الشركات التجارية ودور القضاء في حمايته. فكثيرا ما يكتسب الطفل أموالا عقارية أو منقولة بشتى طرق اكتساب المال، فيكون من الأجدر استثمار هذه الأموال وتفادي تجميدها إلى غاية بلوغه سن الرشد. ولعل أفضل وسيلة لاستثمار أموال الطفل تكون عن طريق المساهمة بها في الشركات التجارية، كونها أفضل وسيلة في تحقيق الربح ومنه تنمية مال الطفل. لكن وما دام أنّ الطفل لا يحوز أهلية التصرف كاملة، فلا يستطيع استثمار أمواله بنفسه، وإنما يكون لزاما تحقيق هذا الاستثمار بواسطة نائبه القانوني، والذي يتمثل في وليه أو وصيه أو مقدمه حتى بلوغه سن الرشد. غير أنّه قد تتعارض مصلحة الطفل مع مصلحة نائبه، مما يسبب تنازعا للمصالح. وهذا الأمر يشكل خطرا على أموال الطفل، مما يقتضي تدخل القضاء لحماية أموال الطفل من تعسف نائبه في استثمار أموال الطفل.
