Sociological Approach To The Legal Phenomenon According To The "social Doctrines

الملخص
Abstract: The law has a close relationship with society and its development does not lack custom, law, prohibitions and social restrictions from any global society, especially since it is the main determinant of the acquisition of the right and the performance of duty, and thus guarantees the rights of all individuals and secures social peace and tranquillity for the individual within his society as well as Even the establishment of laws takes on the factors of the circumstances surrounding each society, whether it relates to the social, psychological, historical, and even economic and cultural factors. The truth between the diverse realities and a real understanding of the elements of the social process to determine the deepest and broader understanding of the relationship between society and the law that has been drafted in general. This is what makes the law a phenomenon in many societies in the world, as we noted in the beginning, is purely concerned with the idea of justice as a concept and a goal within the social pattern of the individual and the state in which he lives, and this invites us to question those readings and social doctrines of justice and law in societies according to a reading Conscious and ultimately in a sociological language. ملخص: للقانون علاقة لصيقة بالمجتمع و تطوره فلا ينعدم العرف و القانون و الموانع و القيود الاجتماعية من أي مجتمع عالمي كان خاصة و انه هو المحدد الرئيسي لاكتساب الحق و أداء الواجب و هكذا تضمن الحقوق لجميع الأفراد و يؤمن السلام الاجتماعي و الطمأنينة للفرد داخل مجتمعه كما أن هاته السياقات الاجتماعية و شكل العلاقات الاجتماعية هي منبع القوانين و روحه فلا شيء يأتي من العدم .فحتى إرساء القوانين يأخذ أساسا بعوامل الظروف المحيطة بكل مجتمع سواء ما تعلق بالعامل الاجتماعي أو النفسي أو التاريخي و حتى الاقتصادي و الثقافي و التركيز على تلك العلاقات الحقيقية بين الحقائق المتنوعة و فهم حقيقي لعناصر العملية الاجتماعية لتحديد أعمق و فهم أوسع للعلاقة بين المجتمع و القانون الذي تم صياغته بشكل عام. و هذا ما يجعل من القانون ظاهرة في عديد مجتمعات العالم كما اشرنا في البداية يهتم بشكل خالص بفكرة العدل كمفهوم و هدف داخل النسق الاجتماعي الواحد للفرد و دولته التي يحيا فيها و هذا يدعونا الى التساؤل عن تلك القراءات و المذاهب الاجتماعية للعدل و القانون في المجتعات وفق قراءة اجتماعية و بلغة سوسيولوجية في نهاية المطاف
