احترام أصول الصياغة التشريعية في ضوء اجتهادات المجلس الدستوري الجزائري

الملخص
تأتي هذه الورقة البحثية لتتبع قرارات وآراء المجلس الدستوري الجزائري الصادرة في إطار رقابته للدستورية، وتحليلها، لبحث مدى اهتمامه باحترام المشرع لأصول الصياغة التشريعية التي لا يستقيم التشريع بدونها، ولتحديد دور المجلس في هذا الموضوع. خلصت هذه الورقة إلى أن المجلس الدستوري الجزائري اهتم كثيرا بموضوع صياغة أحكام التشريع، وقد أرسى أصولا ومبادئ عديدة للحفاظ على سلامة الصياغة مستندا في ذلك إلى أحكام الدستور ولو ضمنيا، وإلى الأسس المتعارف عليها في مجال الصياغة القانونية. This paper follows and analyzes the decisions and opinions of the Algerian Constitutional Council, issued within the framework of its monitoring of the constitutionality of laws, to examine its concern about the extent to which the legislator respects the legislative drafting rules without which the legislation is not good, and to determine the Council's role in this matter. The paper concluded that the Algerian Constitutional Council had attached great importance to the drafting of the provisions of the legislation and had established many principles to preserve the integrity of the drafting, and in that context it had been based on the provisions of the Constitution, even implicitly, and the recognized foundations of legal drafting.
