الملخص
ملخص : لقد نظم المشرع الجزائري المنتجات الصيدلانية بموجب قانون حماية الصحة و ترقيتها اين تم ذكرها على سبيل الحصر بهدف فرض سياسة الاحتكار في حيازتها و توزيعها على فئة معينة من المهنيين دون غيرهم و هذا نتيجة للدور الذي تلعبه هذه المواد في الترقية و حماية الصحة العمومية ، و عملية توزيع المنتجات الصيدلانية و بالاخص الادوية الجنيسة تعتبر من المسائل الحساسة و الخطيرة في نفس الوقت لذلك نظمها المشرع و قسمها الى توزيع بالجملة تشرف عليه مؤسسات صيدلانية مختصة و مرخص لها قانونا بذلك و التوزيع بالتجزئة التي جعلها المشرع من اختصاص الصيدلي دون غيره ، و حتى تتم عملية التوزيع لابد من شروط يجب ان تتوافر في الموزع سواء كان شخص طبيعي او معنوي اذا تعلق الامر بالتوزيع بالجملة و شروط خاصة بالموزع اذا تعلق الامر بالتوزيع بالتجزئة بالاضافة الى توافر اجهزة و محلات مخصصة لذلك و ووسائل نقل لضمان سلامة هذه المادة و وصولها الى المريض محفوظة بطريقة تؤدي من خلالها دورها العلاجي التي صنعت من اجله . Abstract: . The Algerian legislator organized and promoted pharmaceutical products under the Health Protection Act, where they were mentioned exclusively for the purpose of enforcing a monopoly policy in possession and distribution to a certain group of professionals. This is due to the role played by these materials in promoting and protecting public health, The distribution of pharmaceutical products, especially generic drugs, is considered to be a sensitive and serious issue. At the same time, it is organized by the legislator and divided into a wholesale distribution supervised by specialized pharmaceutical institutions, licensed by law and distributed by the legislator. Distribution There must be conditions that must be available in the distributor whether natural or legal person if it concerns wholesale distribution and special conditions for the distributor if it concerns retail distribution in addition to the availability of equipment and shops dedicated to it and transport means to ensure the safety of this material and its arrival to the patient reserved in a manner Through which the therapeutic role that was created for him.
