وضع المهاجرين الأفارقة غير الشرعيين بالجزائر في ضوء القانون الدولي الخاص The African Illegal Immigrants In Algeria Situation In The Light Of Private International Law

الملخص

تهدف هذه الدراسة الى تسليط الضوء من وجهة نظر القانون الدولي الخاص الجزائري على المركز القانوني للمهاجر الإفريقي غير الشرعي المتواجد على الإقليم الجزائري سواء أولئك الراغبين في الاستقرار فيه أو الذين يتخذونه كبوابة للسفر نحو أوروبا. والغاية من ذلك معرفة مدى توافق النصوص القانونية الجزائرية مع الاتفاقيات الدولية التي صادقت عليها الجزائر. وفي سبيل الوصول إلى تلك الغاية حاولنا من خلال هذا البحث تحليل النصوص القانونية الدولية والوطنية ذات العلاقة بالموضوع، فيما يخص دخول الأجنى للإقليم وإقامته فيه وخروجه منه. وفي مقدمة تلك القوانين القانون رقم 08/11 الذي أظهر لنا بوضوح مدى استجابة الجزائر لجميع القواعد الدولية الخاصة بمعاملة الأجنبي بخصوص وضع المهاجرين الأفارقة غير الشرعيين بالجزائر. This study aims to shed light from the point of view of the Algerian private international law on the legal status of the African illegal immigrant present on the Algerian territory whether those who wish to settle in it or who take it as a gateway to travel towards Europe. The aim is to find out the compatibility of the Algerian legal texts with the international agreements that Algeria has ratified. In order to reach that goal, we have tried, through this research, to analyze the international and national legal texts relevant to the subject, with regard to the entry, residency, and exit of the foreigner to the territory. In the forefront of those laws is Law No. 08/11, which clearly showed us how Algeria responded to all international rules regarding the treatment of foreigners regarding the situation of African illegal migrants in Algeria.
