الملخص

مـــلـخـــص: لطالما عانت البشرية من ويلات الجرائم الدولية الخطيرة، فأصبح لزاما عليها إتخاذ كافة الإجراءات وأنجع الحلول لدرء خطرها؛ فكان من هنا تبني مبدأ الاختصاص الجنائي العالمي كآلية لوضع حد لإفلات مرتكبي الجرائم الدولية من العقاب؛ وهو مبدأ يعطي للدول صلاحية محاكمة ومعاقبة مرتكبي الجرائم التي تهدد السلم والأمن الدوليين، بغض النظر عن مكان ارتكابها وجنسية فاعليها وضحاياها. ومن أهم أدوار مبدأ الإختصاص الجنائي العالمي تكريس مبدأ عدم الإفلات من العقاب الذي يعتبر بدوره وسيلة لمكافحة لاعقاب المجرمين وعدم إفلاتهم من المحاكمة. إلاّ أنّ إعمالهما معرض لعدة عراقيل وصعوبات تساهم في ترسيخ فكرة اللاعقاب، منها ما هو قانوني كالحصانة والتقادم وقوانين العفو. وأخرى عملية ذات طبيعة سياسية أو مادية، كالمساس بالسيادة الوطنية. الكلمات المفتاحية: مبدأ الإختصاص الجنائي العالمي- مبدأ عدم الإفلات من العقاب- جرائم دولية- الحصانة- السيادة. Abstract: Humanity has always suffered of serious international crimes. The worst atrocities in recent years in the world have pushed humanity to find solutions to put an end to it. which it was obliged to take all the measures and the most effective solutions to avert its danger, and resulted in the adoption of the universal criminal jurisdiction principle, as a mechanism to put an end to the impunity of perpetrators of international crimes, this principle gives all states the power to try the perpetrators of crimes that threaten security and peace in the world, regardless of where it was committed, and the nationality of the criminal or the victims. And among the most important roles of the principle of universality, the consecration of the principle of non-impunity, which is an effective way to overcome the lack of judgment of criminals and to punish them, however, these principles are held back by several obstacles and difficulties, which ensure impunity. Some of the legal issues, such as immunity, prescription, amnesty laws, and other practice in a political or material way such as sovereignty invoked.
