الملخص: يشكل النظام الذي يحكم الاختصاص والشروط المسبقة لممارسته عاملا رئيسيا في تحديد حدود اختصاص المحكمة الجنائية الدولية في الممارسة العملية، لا سيما مدى إعمال النظام الأساسي للمحكمة للاختصاص الجنائي العالمي، مع التركيز في هذه الدراسة على المادة 13 (ب) و المادة 12 من النظام الأساسي. يشار إلى ممارسة الاختصاص عن طريق إحالة مجلس الأمن التي نصت عليها المادة 13 (ب) من النظام الأساسي على أنها تمنح المحكمة اختصاصا عالميا، في حين تربط المادة 12 بشأن الشروط المسبقة لممارسة الاختصاص ممارسة اختصاص المحكمة بموافقة الدولة كقاعدة عامة. في هذا السياق، تواجه هذه الأحكام عقبات في إعمال الاختصاص العالمي للمحكمة. Abstract: The regime governing jurisdiction and the preconditions to its exercise are a key factor in determining the limits of the jurisdiction of the international criminal court in practice, in particular the extent to which the statute of the court applies universal criminal jurisdiction, with focus in this study on Article 13 (b) and Article 12 of the statute. The exercise of jurisdiction by Security Council referral provided for in Article 13 (b) of the statute is referred to as granting the court universal jurisdiction, whereas Article 12 on Preconditions to the exercise of jurisdiction links the exercise of the court's jurisdiction with the consent of the state, as a general rule. In this context, these provisions face obstacles in applying universal jurisdiction of the court.
