النظام القانوني للمرافق الإستشفائية المختلطة -النموذج الجديد للتغطية الصحية في الجزائر- The Legal System For Mixed Hospitals -the New Model Of Health Coverage In Algeria

الملخص
للصحة العامة أولوية كبيرة لدى الدول يشتى توجهاتها السياسية و الإقتصادية و الإجتماعية، لذا فالباحث القانوني في الجزائر، يجد نفسه أمام مجموعة من من الإتفاقيات و المراسيم و كذا القرارات القانونية التي تهتم بالنشاطات الطبية ، ما يدل على أهمية عنصر الصحة العامة في الدولة الجزائرية خاصة في ظل الظروف الراهنة و محاولة الدولة الحفاظ على استقرار مؤسسات الصحة نظرا لسلسلة الإضرابات على مستوى قطاع الصحة . لذا اعتمدت الجزائر لإصلاح منظومتها الصحية، نموذج جديد في قطاع الصحة والسكان و إصلاح المستشفيات ألا و هو إنشاء هيكل جديد يسمى المستشفى المختلط تحت رقم 18/114 يحمل اسم القانون الأساسي النموذجي للمستشفى المختلط الصادر في العدد 22 من الجريدة الرسمية لسنة 2018 ، ذا الطبيعة المدنية و العسكرية في كل من التسيير و الإنتفاع ، حيث يضمن نشاطات التشخيص و الإستعجالات الطبية الجراحية ليكون مزاحما من الدرجة الأولى للمستشفيات العسكرية من ناحية الموارد و الهيكلة ، لأن هدف المشرع الجزائري الأول و الأخير يكمن في السعي وراء كيفية تطوير آليات المحافظة على صحة المواطنين وقاية و علاجا تطبيقا منه لنص المادة 66 من التعديل الدستوري 2016 و هذا بالفعل ما كان حسب قانون الصحة الجديد رقم 18/11 الذي أكد بدوره على ضمان وقاية وحماية صحة الأشخاص يعد عامل أساسي في تحقيق التنمية الإقتصادية و الإجتماعية من خلال اعتماد مناهج و نماذج متطورة في ميدان الصحة. Abstract : Public health is of a high priority for different nations aside from their political, economic and social orientations. Therefore, the legal researcher in medical sciences in Algeria finds him/herself facing an enormous legal arsenal of agreements, decrees and legal decisions that concern different medical activities, which indicate the immense importance of public health in Algeria giving current circumstances and strikes of medical personnel all over the country. Therefore, Algeria has opted for reforming its health system, a new model in the Health, Population and Hospitals Reform sector, under a new structure labelled as The Mixed Hospital number 18/114 named The Standard Basic Law for Mixed Hospitals issued in the official journal number 22 of 2018, which is civil and military in both management and usage. It ensures diagnostic activities, medical and surgical emergencies to be primarily a first class competitor in terms of resources and structure to sophisticated military hospitals. Consequently, the main aim of the Algerian legislator is to pursue the methods of developing the mechanisms to maintain the health and wellbeing of citizens through protection and treatment by the application of Article 66 of the constitution amended and supplemented by the 2016 constitution. This is with an accordance to the new health act number 18/11, which affirms that the protection and fortification of people’s health is a key factor in achieving economic and social development through the implementation of advanced methods and models in the health sector.
