الملخص

تعد عقوبة الإعدام أقدم العقوبات التي عرفتها البشرية، وهي تتسم بالقسوة والخطورة، ذلك لأنها تؤدي إلى إزهاق روح المحكوم عليه وتحرمه من حقه في الحياة، وما يزيد من أهمية عقوبة الإعدام كونها العقوبة الأكثر إثارة للجدل في الفكر العقابي، فهناك من يدعو إلى الإبقاء عليها لأنها تحقق الأغراض العامة للعقوبة كتحقيق العدالة وردع المجرمين وفي المقابل هناك من ينادي بضرورة إلغائها لأنها تتعارض مع السياسة العقابية الحديثة الرامية لإصلاح الجاني وإعادة تأهيله خاصة وأن عقوبة الإعدام تستأصل المجرم نهائيا من المجتمع. وفي هذه الورقة سنبحث في عقوبة الإعدام كعقوبة استئصالية ومدى تحقيقها للأغراض العامة للعقوبة. The death penalty is one of oldest forms of punishments invented by mankind. A characteristic feature of the death penalty is that is cruel and dangerous since it leads directly to taking a way the life of the convicted and ending his right to be alive. This makes the death penalty the most controversial of all topics in the legal debates related to punishments and penalties. Some scholars call for keeping this from of penalty as it effectively achieves the common aims of maintaining justice and deterring criminals, while others believe that it must be abolished entirely. Their argument is that taking away someone’s life stands in sharp contrast with the latest modern attitudes that prefer rehabilitating the convicted and integrating them back in society. This paper sheds light on this topic; the death penalty as an exclusionary punishment, as well as its effectiveness in reaching the general purposes of the penalty.
