الملخص
لقد إهتم المشرع الجزائري منذ الإستقلال بتطهير الملكية العقارية وإستقرارها ويتجسد هذا الإهتمام من خلال وضع نظام مسح الأراضي العام ، وفي سبيل ذلك سطّرت الدولة عدة إجراءات تنظيمية وسخّرت كل الإمكانات المادية والبشرية حتى يتم تعميم هذا النظام على كامل أرض الوطن. والواقع إن تطبيق عملية المسح العقاري فرضت العديد من الإشكالات المستعصية على وضعية العقارات سواء في بداية المرحلة أي أثناء سير عمليات المسح أو بعد إيداع الوثائق وعملية الترقيم على مستوى المحافظة العقارية. لقد أثرت هذه الإشكالات بشكل سلبي على إستقرار الملكية العقارية ، لذلك إستلزم الأمر ضرورة إيجاد حلول رادعة لهذه الوضعيات وذلك بإعادة النظر في العديد من النقاط وتعديل بعض الإجراءات ومراجعة بعض اللجان المتدخلة في العملية وإزالة التناقضات والتباينات الموجودة بين النصوص والأحكام حتى نكون أمام نظام متين للمسح العقاري يحقق الأهداف والمقاصد التي رسمها المشرع على نحو يسمح بحماية الملكية وإستقرارها. Since the independence of Algeria, the Algerian legislator has been concerned with the cleansing and stability of real estate. This interest is reflected in the establishment of a public land survey system. For this purpose, the government has instituted several organizational measures and provided all material and human resources. The implementation of the real estate survey has imposed many difficult problems on the status of real estate at the beginning of the stage, ie during the conduct of surveys or after the deposit of documents and the process of numbering at the level of the province real estate. These problems have negatively impacted the stability of real estate ownership, so it was necessary to find a deterrent solutions to these positions by reviewing many points and modifying some procedures and reviewing some of the committees involved in the process and removing contradictions and discrepancies between the texts and provisions in order to have a solid system of real estate survey that can achieve the goals and objectives set by the legislator as to protect the property and its stability.
