الملخص
الملخص: في السنوات الأخيرة تنامت ظاهرة غريبة على المجتمع الجزائري ومخالفة لتقاليده وأعرافه ومبادئه ألا وهي ظاهرة الإفطار العلني في شهر رمضان، الامر الذي نتج عنه إستهجان واسع من طرف الغالبية من هذا المجتمع مسلمين كانوا أو غير مسلمين، مما أدي إلى العديد من الاحتجاجات التي شكلت بدورها إخلالا بالنظام العام . ولعل الدافع من وراء تنامي هذه الظاهرة هو الفهم الخاطئ لمبدأ حرية المعتقد والدين المكرسة دستورا والمنظمة قانونا، وتأتي هذه الورقة كمحاولة لتسليط الضوء على الموازنة ما بين حق الشخص في ممارسة حرياته وحق المجتمع في حفظ النظام العام، ومن ثمة دفع المشرع لوضع حد لهذه الظاهرة على غرار العديد من التشريعات العربية. الكلمات المفتاحية: ظاهرة – رمضان – الإفطار العلني- المعتقد- انتهاك. Abstract: I In this recent years, a strange phenomenon has grown in Algerian society and a violation of traditions and morals and principles is the phenomenon of eating before all the public in the month of Ramadan, which resulted in a very Largely the majority party of this Muslim society were or not Muslim, which led to many protests, which in turn constituted a violation of public order. Perhaps the motive behind the growth of this phenomenon is the misunderstanding of the principle of freedom of belief and religion consecrated constitution and organization legally, come this article is an attempt to shed light on the balance between the right Of a person in the exercise of the freedoms and the right of society to maintain public order, and legislators are pushed to put an end to this phenomenon in many Arab laws.
