حماية حق الطفل المحضون في النفقة وفقا للقانون رقم 15-01

الملخص
ملخص: لقد استحدث المشرع الجزائري صندوق النفقة للمطلقات الحاضنات بموجب القانون رقم 15-01 كآلية قانونية من آليات حماية حق الطفل المحضون في النفقة، الغرض منه التكفل المادي بالأطفال المحضونين على وجه الخصوص متى تعذر تنفيذ الأمر أو الحكم القضائي المحدد لمبلغ النفقة، من أجل حماية الحقوق الأساسية للطفل في حالة طلاق والديه وضمان العيش الكريم له متى توافرت فيه شروط وحالات الاستفادة من هذا الصندوق. Résumé Le législateur algérien, par le biais de la loi n° 15-01, a adopté les dispositions régissant le fonds de la pension alimentaires des divorcèes à qui on a attribué le droit de garde des enfants. Cette loi est, entre autres, un moyen de protéger un droit fondamental de l’enfant en cas de divorce de ses parents, en l’occurrence le droit à la pension alimentaire et ce, dans le cas où l’exécution de la décision juridictionnelle fixant son montant, pour une raison ou une autre, n’a pu avoir lieu. Or, le bénéfice de cette redevance ne peut être mis en application qu’une fois certaines conditions fixées par loi soient requises. Abstract The Algerian legislator has made a new alimony fund in favor of the divorced women exercising the right of guardianship and custody for children according to article n° 01-15 as a way to protect the right of children in alimony in order to guarantee the child’s compliance, specially ensuring a physical proper care in case where it is enable to execute the judgment issued in this regard. In order to protect the fundamental rights of the children in case where his parents are divorced, insuring him a suitable life, and abiding to some conditions in order to benefit from this fund.
