الاستخلاف في القضاء وعلاقته بمقاصد الشريعة

الملخص
يبحث هذا المقال في قضية الاستخلاف في القضاء أو ما يعرف في المصطلح المعاصر بالنيابة القضائية تاريخا وتأصيلا وأحكاما في ظل مقاصد الشريعة ، والتي ما يخلو حكم من الأحكام الشرعية ولا نظاما من النظم الإسلامية إلا وكان ارتباطها بمقاصد الشريعة ارتباط السوار بالمعصم ، وقد بين هذا البحث أهمية الاستخلاف في القضاء وشروطه وأحكامه منذ عهد رسول الله صلى الله عليه وسلم فمرورا بمختلف الأزمنة والعصور، كما يتطرق البحث لجهات تعيين نواب القضاة ومتابعتهم وعزلهم ، كما يتناول البحث اختصاصات ومهام نواب القاضي والشروط المطلوبة فيمن يتولى مهام الاستنابة ويخلص البحث بخلاصة تمثل لب نتائج البحث . الملخص بالفرنسية Résumé: Cet article examine la question de la jurisprudence du système judiciaire ou de ce que l’on appelle couramment le système judiciaire judiciaire d’histoire, d’origine et de décisions à la lumière des objectifs de la charia, qui est libre de toute règle ou système islamique. L’étude aborde également l’importance de l’arbitrage dans le système judiciaire ainsi que ses modalités et conditions depuis l’époque du Messager d’Allah (paix et paix), ainsi que sur la nomination, le suivi et la destitution de juges, ainsi que sur les fonctions et fonctions des juges suppléants.
