فقه البدائل وأثره في الفتوى

الملخص
ملخص البحث: إن أثر الفتوى في تغيير السلوك، والحمل على الالتزام، رهين بالدلالة على البديل الشرعي عن الحرام، ولذلك انتصب هذا البحث لغرض معالجة مسألة ( فقه البدائل وأثره في الفتوى )، ودار على تأصيل مفهوم فقه البدائل أولاً، ثم عرج على تأصيله وعوائده، وانتهى إلى رصد بعض تطبيقاته في الفتاوى المعاصرة. وكان من النتائج التي تأدّت إليها الدراسة أن هذا الأدب الإفتائي الجليل يأخذ بيد المستفتي في طريق التديّن الأمثل، ويخلصه من عمايته، ويعينه على التخلص من الحرام بأيسر سبيل وأقل كلفة، فضلاً عن أنه مَلمحٌ من الملامح المضيئة للتشريع الإسلامي يعكس جنوحاً إلى التيسير، ورسوخاً في الواقعية، وسموّاً في الجانب المصلحيِّ. Abstract: Verily the effect of Fatwa (jurisdiction) in changing people’s behaviors and making them committed to the Sharia laws, related to guiding people to the permitted alternative. For the previous reason was this research to process jurisprudence of the alternatives, and its effects in Fatwa (jurisdiction). First, this research has worked on finding the origin of concept of jurisprudence of the alternatives in the Quran and Sunnah and find the outcomes of it. And finally it spots the light on some examples to be applied in the modern Fatwa. One on the outcomes and benefits of this study is to take questioner’s hand to perfect way to be religious and it’s saver for the questioner from ignorance helping him to get rid of the prohibits and forbidden deeds in the easiest way and minimum effort. In addition to that, it highlights the beautiful and shining aspects of Sharia which reflect how easy, close to reality and advanced in looking for the advantages of the people.
