ضوابط الفرض الكفائيّ بين التّأصيل والتّمثيل: دراسة تحليلية نقدية

الملخص
ملخص: يُعدُّ الوجوبُ الكفائيُّ من المباحث الأصيلة في أدبياتِ الدرس الأصوليِّ، وقد كان لأهل الفنِّ قيامٌ على ضبط مناطه، وتمييز فروضه، وإجلاء الفروقِ بينه وبين الوجوب المتعلّق بأعيان المكلّفين وامتحانهم. ثم تعاور الفقهاءُ التَّمثيلَ له في كتبهم، ومنهم السويُّ صاحبُ الذّوق والفقاهة المتناهية، والمكبُّ على وجهه ! فلا بدعَ إن وُجد من الشّواهد المنصوصة، والمــُثُلِ الشّارحة، ما أزيلَ عن وجه الكفاية، وانتحى شذوذاً من القول؛ حتى ليعزُّ وجدانُ الاطمئنان والثّلَج من ذكر تنصيصٍ أو تمثيلٍ عارٍ عن مُدركهِ، فإذا عُرف بالفحص عنه والتَّشمير له، وسلِم من الإعلال، صار المصيرُ إليهِ أقرَّ للعين، وأثلجَ للصّدر. والحقُّ أنَّ تقعيدَ الأصوليين لضبطِ الوجوبِ الكفائيِّ متفاوتٌ جودةً وشفوفاً، وأسدُّ الضوابطِ وأجراها على المقاصد ما كان لمحُهُ قويّاً لبعدين متلازمين : بعدِ المصلحةِ المقصودةِ من تشريع الفرض، وبعدِ الكفايةِ المنوطةِ بفعل البعض؛ ولذلك تجدهم يقيمون ضبطَ الكفايةِ بعبارة جامعة بين البعدين: ( حصول المقصود بفعل البعض أ الواحد ).
