الملخص
الملخص تهدف هذه الدراسة إلى تبيان الدور الهام للقاضي الإداري في ضمان حوكمة تسيير الجماعات المحلية، من خلال ممارسة رقابته على قراراتها لجعلها متطابقة مع النصوص القانونية المكرسة لمبدأ عدم التحيز الذي يضمن المساواة في الإستفادة من الخدمات العمومية، ومبدأ الديمقراطية التشاركية الذي يهدف إلى تفعيل مشاركة المواطنين في البرامج المتعلقة بشؤونهم، خاصةً أمام غياب هيئات إدارية تساهم في الدافع عن حقوق المواطنين في حالة تعسف الإدارة المحلية عند القيام بنشاطاتها. Abstract This study aims to demonstrate the important role of the administrative judge in ensuring the governance of the local groups by exercising control over their decisions to make them compatible with the legal texts devoted to the principle of impartiality which guarantees equal access to public services and the principle of participatory democracy, in order to activate the participation of citizens in the programs related to their affairs in order to ensure the transparency of local governance, especially in the absence of administrative authorities that contribute to the motivation for the rights of the citizens when the abuse of the Local administration in exercising its activities
