الملخص
الملخص: يعد العقار عامل أساسي لإنجاز مختلف المشاريع الاقتصادية، وملكيته تحقق التنمية المستدامة. و ذلك اعتمادا على تعديلات التشريعات العقارية منذ 2008 إلى نهاية 2014 . و التي تؤكد أيضا، إرادة المشرع في ضبط سوق العقار، مع احتفاظ الدولة بدور المراقب لتطبيق القانون. فهي تبقى مالكة للأرض التي ستقام عليها المشاريع، لكن مع ضرورة حماية ملكية المستثمر الخاصة للمعقارات المبنية . RESUME : L’immeuble, reste toujours le facteur clé pour la réalisation de divers projets économiques, sa propriété réalise le développement durable. Ceci est fondé sur les modifications de la législation de l'immobilier depuis 2008 à la fin de l'année 2014. Et ces modifications confirment aussi, la volonté du législateur de contrôler le marché immobilier, tout en conservant à l’État le rôle d'observateur et de faire respecter la loi. Elle reste la propriétaire du terrain sur lesquelles le projet sera bâté. Mais, il faut toujours protéger la propriété privée de l’investisseur, par l’acquisition d’immeubles construits. ABSTRACT : Real Estate, remains the key factor for the realization of various economic projects, its property achieves development durable. This is based on modifications of real estate legislation since 2008 at the end of 2014. And these modifications, also confirm the legislator’s desire to control the real estate mar, with retaining to the State the observer role and enforcing the law. It remains the owner of the land, on which the project will be built. But, it is always necessary to protect the private property of the investor, by the acquisition of constructed buildings.
