الحياد الوظيفي والحرية الدينية للموظف العام

الملخص
تعد حريتي العقيدة والعبادة من الحريات الأساسية لكل إنسان، وتختلف حرية العقيدة عن حرية العبادة في أن الأولي تأخذ المظهر الخفي الباطني الذي لا يظهر للناس فهو بين العبد وربه، والثانية تأخذ المظهر الخارجي الظاهر الدال علي معتقد صاحبه، وعلي الرغم من أن كافة مواثيق الأمم المتحدة وأغلب دساتير الدول تنص علي هاتين الحريتين إلا أن الدول نفسها تختلف فيما بينها في مفهومها عن هاتين الحريتين، فدولة فرنسا مثلاً تعتنق العلمانية مذهب لها مما له أثر واضح عند تفسيرها لمبدأ حريتي العقيدة والعبادة عن دولة مصر مثلاً التي تعتنق الإسلام كدين رسمي للدولة، وإن كان يبدو أن الاختلاف بين الدولتين يظهر بشكل واضح في حرية العبادة، ونظرا لأن الموظف العام في أي دولة يمثل مكونًا رئيسيًّا فيها وجزءًا من شعبها فهو يتمتع بهاتين الحريتين كباقي المواطنين، ولكن بضوابط معينة تتعلق كلها بطبيعة الوظيفة العامة التي ارتضي العمل بها، والتي بالطبع تختلف من دولة لأخري حسب طبيعة الفكر الذي تعتنقه الدولة بالنسبة لهاتين الحريتين.
