الملخص
الملخص: تشكل دراسة المرفق العام أهمية كبيرة في حقل القانون الإداري، فالمرافق العامة تهدف إلى تحقيق المصلحة العامة من خلال الحاجات التي تلبيها لفائدة المواطنين، ولا ترمي إلى تحقيق الربح وهذا تكريسا للحياد التجاري، لكن التحولات التي عرفها مفهوم المرفق العام و انتقاله من المفهوم التقليدي إلى المفهوم الحديث جعله يسير في فلك المنافسة وتحقيق الفاعلية في الإنتاج والخدمات؛ فالمنافسة وفقا للطرح القانوني والاقتصادي لها تأثير كبير على أداء المرفق العام متى توفرت الشروط لذلك؛ وقد نتج ذلك عن اعتماد نظم التسيير الحديثة كالتفويض مما أدى إلى تراجع نطاق الحياد التجاري للمرفق العام. Abstract: The study of public service is of great importance in the field of law, and it generally aims to achieve the public interest through the needs it meets for the benefit of citizens, and is not aimed at making a profit and it is a dedication to commercial neutrality, but the transformations that the concept of public service is experiencing and its passage from the traditional concept to the modern concept Bring it into the orbit of competition and achieve efficiency in production and services ; Competition consistent with the legal and economic proposition has a significant impact on the performance of the public service when the conditions are right for it; This resulted from the adoption of modern management systems such as delegation, which led to a decline in the scope of the commercial neutrality of the public service
