حماية الأسرة من النزاعات المالية بين الزوجين

الملخص
ملخص: يُنشأ عقد الزواج حقوقا وواجبات مالية بين الزوجين، وحتى يتجنّب الزوجين المشاكل التي قد تترتب عن المشاركة المالية بينهما، وجب إيجاد قواعد تحكم وتضبط المصالح المالية بينهما، سواء فيما يخص الأموال المكتسبة من طرف كل واحد منهما قبل الزواج، أو فيما يخص الأموال التي ستكتسب بعد قيام العلاقة الزوجية، وذلك حتى يأخذ كل واحد منهما حقه ولا يتعدّى على حق الآخر، لأنّ الحياة المشتركة بين الزوجين والتي يفرضها عقد الزواج تجعل من اختلاط أموال الزوجين حتمية لازمة، لذا أصبحت مسألة وضع قواعد مضبوطة تنظّم العلاقة المالية بين الزوجين وتجنّبهما الخلافات والنّزاعات أمرا من الأهمية بمكان، حتى نحافظ على قيام العلاقة الزوجية، وبالتالي نحفظ على الأسرة استقرارها وأمنها. Abstract The marriage contract establishes financial rights and duties between the spouses. In order for the spouses to avoid the problems that may arise from the financial participation between them, the control rules of the financial interests between them should be established. These rules should be in respect to the funds acquired by each of them prior to the marriage and after the marital relationship. This way, each of them takes their right and does not infringe on the other's right. The reason is that the joint life between the spouses and imposed by the marriage contract makes the merge of the couple's money inevitable. The issue of establishing rules governing the financial relationship between spouses to avoid disputes is important, so that we maintain the marital relationship and thus preserve the family’s stability and security.
