المرتكزات القيمية للمواطنة في ضوء مقاصد الشريعة

Résumé
إن مصطلح المواطنة وإن كان معاصرا فرضته عوامل التطور والانفتاح على العالم بعد أن لقي اهتماما من قبل علماء السياسة والاجتماع والقانون، إلا أن مضمونه كان له حضور قوي لدى فقهاء الإسلام، من خلال مصنفاتهم المتعــددة في الفــقه السيــاسي بمخــتلف مجـالاتــها، في كــتب الأحكــام السلطــانية، وكــتب المـرايا التـي تعـتني بنصـائح الملـوك وكـتب الإصـلاح السياسي والاجتماعي . وقـد حــاول البحــث أن يقـرب صـورة المـواطـنة في الفـكـر السـياسـي الإسـلامي الذي ينطـلق من رؤية شـاملة للإنسـان والكـون والحـياة لتحـقيق مقصد الاستخلاف والعمران بإقامة مجتمع تقوم بنيته السياسية على مراعاة الحقوق والواجبات التي تتأسس عليها فكرة المواطنة، وذلك بوضع قواعد تنظيمية لضبط علاقة الفرد بالسلطة والمجتمع الذي يعيش فيه ويشعر بالانتماء إليه .وهي مرتكزات قيـمية تحـمى حقوق الإنسـان وتراعيـها بما يتـوافق مع أهداف الشريعة ومقاصدها . The content of the term of citizenship, though contemporary and imposed by the development and the openness to the world factors, was very known to the Islamic scholars through their many books on political jurisprudence in its different fields. If you have a view on the book of “Alahkam As-sultaniyyah”, the book of “Almaraya” that deals with Counsel for Kings and the books of political and social reform. The research sought to bring the image of citizenship closer to the Islamic political thought, which stems from a comprehensive vision of man, the universe and life to achieve the purpose of settlement and construction by establishing a society whose political structure is based on the rights and duties on which the idea of citizenship is based. And feel that they belong to it. It is a moral foundation that protects human rights and respects them in accordance with the objectives and purposes of the Shari'a.
