الملخص
لقد اعتنت الشريعة الإسلامية بحال المجتمع، أفرادا وجماعات، وقصدت وقايته ومعالجته من جميع الآفات؛ ولذلك شرّعت الأحكام، ووضعت الوسائل، التي تحقق صلاح الأمة في جميع أحوالها. ولهذا جاءت هذه الورقة؛ لتبيّن جهد العلاّمة محمد الطاهر بن عاشور في كتابه مقاصد الشريعة الإسلامية، وكيف أبدع في إبراز مقاصد الشارع الحكيم من العقوبات، ودورها الفعّال كوسائل في محاربة الآفات الاجتماعية. ولدراسة الموضوع، تمّ تقسيم البحث إلى ثلاثة مباحث، تناولت التعريف بالمصطلحات، وكذا بيان المقاصد الشرعية من العقوبات، والوسائل الشرعية ودورها في الوقاية من الآفات الاجتماعية ومعالجتها. وفي الأخير، تمّ وضع خاتمة تضمّنت النتائج المتوصّل إليها، وجملة من التوصيات التي تخدم أهداف الملتقى. Islamic law took care of the condition of the community, both individuals and groups, and intended to protect it and treat it from all pests. Therefore, the rulings were legislated, and the means were put in place, which achieve the good of the nation in all its conditions. That is why this paper came; To show the effort of the scholar Muhammad al-Tahir ibn Ashour in his book, The Purposes of Islamic Sharia, and how he excelled in highlighting the purposes of the wise legislator regarding punishments, and their effective role in combating social ills. In order to study the subject, the research was divided into three sections, which dealt with the definition of terms, as well as the statement of the legitimate purposes of punishments, and their role as means in preventing and treating social ills. Finally, a conclusion was drawn up that included the results reached and a set of recommendations that serve the objectives of the forum.
